Yes—if you own, manage, or are responsible for a property that is not a single private home, you are legally required to have a Fire Risk Assessment in place.
Under UK fire safety legislation, a Fire Risk Assessment is mandatory for:
- Businesses and commercial premises
- Rental properties (including HMOs and blocks of flats)
- Communal areas in residential buildings
- Public buildings such as schools, offices, and shops
If you are the “responsible person” (e.g. landlord, employer, or managing agent), it is your duty to ensure that a suitable and sufficient Fire Risk Assessment is carried out and kept up to date.
For single private homes, a formal Fire Risk Assessment is not a legal requirement—but it is still strongly recommended to help protect your property and the people living in it.
The responsibility for carrying out a Fire Risk Assessment lies with the “Responsible Person” for the property.
This is typically:
- The employer, in a workplace
- The landlord, for rental properties
- The managing agent or freeholder, for communal areas in flats
- The owner or occupier, for commercial premises
The Responsible Person is legally required to ensure that a suitable and sufficient Fire Risk Assessment is completed and regularly reviewed.
Failing to conduct a Fire Risk Assessment can have serious legal and safety consequences.
If you are the Responsible Person and do not comply with fire safety regulations, you may face:
- Enforcement action from the local Fire Authority
- Fines or prosecution
- In severe cases, imprisonment
Fire officers can carry out inspections and, if they find that a Fire Risk Assessment is missing or inadequate, they may issue enforcement notices requiring improvements—or even prohibit the use of the premises until the risks are addressed.
Beyond legal penalties, not having a Fire Risk Assessment puts lives at risk. It increases the likelihood of fire incidents, property damage, business disruption, and potential harm to occupants, employees, or visitors.
The time it takes to produce a Fire Risk Assessment report depends on the size, complexity, and type of your property.
- Small properties or single commercial units: Usually 1–2 hours on-site, with a report provided within 1–3 days.
- Larger buildings or multi-occupancy sites (e.g., blocks of flats, offices, or schools): On-site inspection may take several hours to a full day, with the report delivered in 3–5 days.
- Complex sites with multiple hazards: May require additional surveys or consultation with specialists, which can extend the timeline.
Once the assessment is complete, the report will outline identified risks, recommended actions, and a schedule for review, ensuring your property meets fire safety requirements.
- The assessment must be reviewed whenever there are significant changes to the building, its use, or occupancy.
- Even without major changes, most Responsible Persons review their Fire Risk Assessment at least once a year.
- Any fire, near miss, or significant safety event should trigger an immediate review.
